Ratten v.s Queen
- This case law is based on Ges Restae principle which is in Sec 6 of Indian Evidence Act ,1872.
- According to sec 6 of Indian Evidence Act,1872 Facts which are not in issue though connected with facts in issue as to form the part of the same transaction are relevant whether they occured at the same time and place or at different times and places.
- In this case the victim(wife) called police and was feared while talking and suddenly the call got disconnected .
- Later it was found that the victim was Dead and her body was recovered from the same place from where she had called the police .
- After the postmortum it was found that she had died after the call was disconnected
- These all facts became relevant and Her Husband was held culprit .
